We at Aveda Pure Privilege respect your privacy and value the relationship we have with you.  Your participation in the Aveda Pure Privilege Program is subject to this Privacy Policy and our Terms and Conditions.

This Privacy Policy describes the types of personal information provided to Aveda Pure Privilege (the “Program”), how we may use that information and with whom we may share it.  Our Privacy Policy also describes the measures we take to protect the security of this information as well as how you can access, modify or delete your personal information.  It also explains how you can object to the processing of your personal information or to receiving communications about our products and services.

Please note that this Privacy Policy governs only information provided to Aveda Pure Privilege in stores and online at the Aveda Pure Privilege Website (the “Website).  It does not govern any other information or communications that may reference Aveda, e.g., communications from Aveda freestanding stores (other than an Aveda Pure Privilege application that you may submit to an Aveda store).  If you visit one of our other regional websites, e.g. aveda.com, or link to another website from the Website, you are subject to the privacy policy applicable for that website and we suggest that you consult such privacy policy.

    Use of Personal Information by Aveda Pure Privilege

    To participate in the Program, you must complete an Aveda Pure Privilege enrollment form, providing your name, home and/or business address and phone number(s) in store.  You may also elect to provide us with your email address, mobile phone number and birth date.  As an Aveda Pure Privilege member, you will be issued a membership card.  Users who wish to access their information on the Website must provide their name, email address, birthdates, and Pure Privilege card number in addition to selecting a username.  Aveda Pure Privilege will provide you with a password, which you may later change, to access your account on the Website.  It is your responsibility to maintain the security of your username and password.

    • Marketing Communications

      Pure Privilege is committed to building good will and allegiance among Aveda’s most important customers.  When you elect to join Aveda Pure Privilege and provide us with your contact information, you are electing to receive communications from Aveda Pure Privilege and Aveda’s approved business partners via the method for which contact information was provided. The information you provide may be used by Aveda Pure Privilege to create and deliver to you our newsletters, surveys or other communications containing Aveda product and Program event information, beauty tips or promotions (“Communications”).  If you prefer not to receive such Communications, please do not elect to receive them.  If you do so elect and later decide that you would no longer like to receive these Communications, see “Your Choices” Section below.

    • Text Messages

      If you so elect, you may provide your mobile phone number in order to receive text message alerts containing product and event information, cosmetics tips or promotions (“Text Messages”).  There is no fee from Aveda Pure Privilege to receive Text Messages, however, your mobile service provider may charge you for sending and/or receiving text messages and air-time, as well as any other standard applicable rates charged by your mobile service provider. If you do elect to receive them and later decide that you would no longer like to receive these Text Messages, see the “Your Choices” Section below.

    • Communications to Serve You

      If you have elected to join Aveda Pure Privilege, we will use your personal information to provide you with membership information, including a membership card.  For example, when you choose to complete an application, Aveda Pure Privilege may use your personal information to respond to your requests and inquiries and provide you with information related to your membership, e.g., benefits, expiration, and to confirm receipt of your application form or to address an issue with your membership.  These types of communications are necessary to serve you, respond to your concerns and to provide the high level of customer service that Aveda Pure Privilege offers its members.

      Please note that in order to provide you with these services, you must consent to receive Aveda Pure Privilege communications by email, postal mail and/or telephone (including SMS messages).  If you prefer not to receive communications by email, postal mail and/or telephone (including SMS messages), please do not join Aveda Pure Privilege, or if you have already joined, please follow the instructions in the “Your Choices” Section below in order to opt-out.  You may choose not to provide us with your email address or mobile number and not to receive Communications via email and text messaging but this may limit our ability to provide you with the full range of Aveda Pure Privilege services and events from which you might otherwise benefit.

    • Special Events, Questionnaires and Surveys

      On occasion, Aveda Pure Privilege may sponsor special events (such as contests, sweepstakes or other offerings), questionnaires and surveys.  At the time you enter these promotions, we may obtain your consent to send future promotional communications.

      If a special event is jointly sponsored by us and one or more other sponsors, you may chose to permit sharing your personal information with such sponsors as specified at the time of collection of your personal information. We do not control the use, disclosure or security of your personal information by other sponsors, and recommend that you carefully review their respective privacy notices, statements and terms of use before agreeing to share your personal information. If you do not wish your information to be shared with joint sponsors in this manner, you may express this preference when you enter the relevant contest, sweepstake or other promotion.

      There may be specific rules applicable to these promotions that explain how any personal information you provide will be processed.  We strongly suggest you review any applicable rules before participating.  To the extent any special event, questionnaire or survey is not subject to specific rules, the processing of personal information is governed by this Privacy Policy and the purposes it sets forth.

    Other Website Features We offer our Website visitors various features for their information and enjoyment, which we may change from time to time. We may ask you to submit certain personal information so we can provide you with these features.

    Technologies That Allow Us To Customize Your Experience On Our Website

    We use various technologies to collect information (such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request) about your visit to our Website and to enhance and customize your experience on our Website.  For example, we may collect the Internet Protocol (IP) address identifying your computer or device and indicating your geographic region for statistical purposes. In some instances, we may use these technologies in combination with the personal information you provide on the Site.  These technologies may provide a variety of information such as whether you have visited our Site before.  They also may enable you to save your preferences.  Each technology is explained below.  You will be offered the opportunity to opt-out of the use of cookies (explained below) during the Site registration process.

    • Web Beacons and Tracking Links

      Web beacons (also called clear gifs and pixel tags), tracking links and/or similar technology consist of a few lines of code and are embedded on the pages of our Site.  They are often used in combination with cookies and are often not visible to the user of the Site.  Web beacons may relay information to third parties such as our service providers and may be used in order to track customer response to certain advertising, to better target interactive advertising and to enhance customer support and usability.  If you reject our cookies (see Cookie section below), you will prevent Web beacons from relaying this information about you and may limit your use of some of our Website features.

      Browser cookies are bits of text that are placed on your computer’s hard drive when you visit our Site.

      Flash cookies are similar to browser cookies except that they can store data more complex than simple text and are stored in your browser rather than on your hard drive.

      You can have your browser and/or plugs to your browser, such as flash, notify you of, or automatically reject, cookies.  If you reject our cookies, you may still use this Site, but you may be limited in the use of some of its features.

    • Coremetrics

      We are continuously working to make your experience on our Website better.  To this end, we have retained a company, Coremetrics, to assist us in better understanding your use of our Website.  We will place cookies on your computer to collect information that will show us how you come to our Website and how you use and navigate our Website. Coremetrics does not receive any directly identifiable personal information about you but Coremetrics will receive and process indirectly identifiable personal information including your computer’s IP address.     Information We Share and With Whom We Share It

    We will not provide your personal information to third parties for their use in marketing their products or services to you without your consent, except as provided in the “Business Transfers” Section below, and as explained above in the “Special Events Questionnaires, Surveys” Section.  In addition, we do not sell or otherwise disclose personal information about our members except as described here.

    • Aveda Companies

      We may share your personal information with our affiliates (companies linked to Aveda) that distribute and market Aveda products (the “Aveda Companies”).  Aveda Companies may use this information in accordance with this Privacy Policy including to send you Communications containing product information, cosmetic tips or promotions.  We are unable to offer the benefits of Aveda Pure Privilege to anyone who does not consent to the sharing of their personal information with Aveda Companies.

    • Third Parties

      We retain other approved business partners and individuals to perform functions on our behalf consistent with this Privacy Policy.  Examples include data analysis firms, customer support specialists, email vendors, webhosting companies and fulfillment companies (e.g., companies that coordinate mailings).  Such third parties may be provided with access to personal information needed to perform their functions but may not use such information other than on our behalf and in accordance with this Privacy Policy.  These third parties may be located in the country in which your personal information was provided or another country that may not guarantee the same level of protection as the one in which you reside. 

      In addition, in some instances, you may be offered the opportunity to consent to the sharing of your information with a third party such as an event or promotion co-sponsor.  If you consent, we will share your information with such third party and the information you provide may be used by such third party for their own purposes and in accordance with their own policies.

    • Business Transfers

      As we continue to develop our business, we might sell certain of our assets.  In such transactions, user information, including personal information, generally is one of the transferred business assets, and by providing your personal information to us you agree that your data may be transferred to such parties in these circumstances.  You may choose not to have your information transferred as a business asset by contacting us as described in the “Your Choices” Section.

    • Compliance With Law and Fraud Protection

      We may disclose information that is necessary to comply with any applicable law, regulation, legal process or governmental request.  In addition, we may disclose any information when it is necessary to prevent physical harm or financial loss or in connection with suspected or actual illegal activity.

    Transfer of Data to Other Countries

    The Aveda Companies, approved business partners and third parties who may receive your personal information in accordance with this Privacy Policy and the databases in which your personal information is stored shall be located in the European Union as well as in the United States and other countries which may not guarantee the same level of protection for personal information as the one in which you reside. All Aveda Companies, approved business partners and third parties that receive your personal information are required to honor the privacy representations made in this Privacy Policy, regardless of where they are located.  Aveda Pure Privilege is unable to offer the benefits of Aveda Pure Privilege to anyone who does not consent to the transfer of their personal information to the United States and other countries outside the European Union which may not guarantee the same level of protection for personal information as the one in which you reside.  If you provide personal information to Aveda Pure Privilege and later decide you no longer wish to consent to the transfer of your personal information as described in this paragraph, please contact us as described in the “Your Choices” Section of this Privacy Policy.

    Children’s Privacy

    Aveda Pure Privilege is not designed for children and as such, participants must be eighteen years of age or older.  If you are under eighteen years of age, please do not join Pure Privilege or provide your personal information to us.  If we become aware that we have inadvertently received personal information from an individual under the age of eighteen, we will delete the information from our records and cancel the subscription with Aveda Pure Privilege.

    How We Protect Personal Information

    We maintain appropriate administrative, technical and physical security safeguards in an effort to protect against loss, misuse or unauthorized access, disclosure, alteration or destruction of the personal information you provide to Aveda Pure Privilege, in our stores, on our Website and through other means. Unfortunately, no collection or transmission of information over the Internet can be guaranteed to be 100% secure, and therefore, we cannot ensure or warrant the security of any such transmission.

    As explained in Use of Personal Information by Aveda Pure Privilege section above, your online access to certain of your personal information may be protected by a password you select. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (including unsolicited correspondence such as postal mail, telephone calls or email messages). We have personal information retention processes designed to retain personal information of our customers for as long as it remains necessary for the purpose stated above or to otherwise meet legal requirements.

      We may request certain personal information for the purposes of verifying the identity of the individual seeking access to his or her personal information records and as necessary in order to process your request. 

    • Opt-Out and Managing Your Preferences

      You may choose whether or not you would like to receive Communications from Pure Privilege by accessing your account at www.pureprivilege.com and visiting the “Preferences” page or by calling 800.230.8051.  You may also change your preferences with respect to Communications at any time by clicking the "unsubscribe" link at the bottom of any Aveda Pure Privilege email you receive from us or by visiting a participating Aveda store or salon or emailing us at AvedaMemberinfo@usafill.com.  You may unsubscribe from receiving Text Messages, by emailing us at AvedaMemberinfo@usafill.com.  If you elect not to receive Communications via postal mail or telephone, you may no longer be a member of Aveda Pure Privilege.

      In addition if you would like to change your other preferences, e.g, with respect to Business Transfers, or the transfer of data as described in Transfer of Data to Other Countries, please contact us at AvedaMemberinfo@usafill.com.  Please note that if you withdraw your consent to certain processing and/or transfers, we may no longer be able to provide you with the benefits of Aveda Pure Privilege and will delete your personal information if required in response to your request.

    • Data Controller/Data Processor

      Aveda Pure Privilege will assume control and responsibility for the personal information that you provide to us.  ELC Online Inc., 65 Bleecker Street, New York, New York 10012, USA will collect, host, and process such personal information.
